These Terms & Conditions (“Terms”) govern your access to and use of the Texas Airport Council app (the “App”), provided by Texas Airport Council (“we,” “us,” or “our”). By creating an account or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

To use the App, you must:

• Hold a valid pilot license or be affiliated with a participating aviation organization, and
• Meet the minimum age required to hold such a license or credential in your jurisdiction.

We reserve the right to verify eligibility and to suspend or terminate accounts that do not meet these requirements.

2. Account Registration

You agree to provide accurate, current, and complete information when creating your profile, including your name, pilot license number, and contact details, and to keep this information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Flight Logging and Validation

• Automatic Validation: The App uses geolocation to detect and validate airport visits. Validation accuracy depends on device settings, connectivity, and location permissions, and we do not guarantee that every visit will be automatically detected.
• Manual Validation: Where automatic validation is unavailable, you may submit a manual request with supporting documentation. Manual requests are reviewed and approved or rejected at the discretion of Texas Airport Council administrators.
• Accuracy of Records: You agree not to submit false, altered, or misleading flight logs, documents, or validation requests. Texas Airport Council may audit, adjust, or reject entries found to be inaccurate.

4. Rankings, Leaderboards, and Achievements

Rankings, leaderboards, and achievements are calculated based on validated flight activity and the rules configured by Texas Airport Council administrators, which may include weighting for specific flights or airports. Administrators may adjust leaderboard rankings for verified errors, rule violations, or special events. Rankings reset annually; historical data remains accessible after each reset.

5. Acceptable Use

You agree not to:

• Falsify geolocation data, flight logs, or supporting documentation
• Attempt to manipulate rankings or leaderboard results through fraudulent activity
• Interfere with the App’s security, functionality, or availability
• Use the App for any unlawful purpose or in violation of any applicable aviation regulation
• Share your account credentials with another person

Violations may result in suspension or termination of your account, removal of falsified data, and adjustment of rankings.

6. Administrator Authority

Texas Airport Council administrators are responsible for reviewing validation requests, managing airport listings, and overseeing participant conduct. Administrators may approve, reject, or adjust flight validations and take action against accounts for rule violations or suspicious activity, in accordance with Texas Airport Council’s policies.

7. Intellectual Property

The App, including its design, features, graphics, and underlying software, is owned by Texas Airport Council or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the App without prior written consent.

8. Third-Party Services and Links

The App may incorporate or link to third-party services (e.g., mapping, weather, payment processing, cloud storage). We are not responsible for the content, accuracy, or practices of third-party services, and your use of them is subject to their own terms.

9. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. Geolocation-based validation may be affected by factors outside our control, including device limitations, signal availability, and third-party mapping data. We do not warrant that the App will be uninterrupted, error-free, or that all airport visits will be detected or validated. The App is a tracking and record-keeping tool only and is not intended for use as a primary source of flight planning, navigation, or aeronautical decision-making.

10. Limitation of Liability

To the fullest extent permitted by law, Texas Airport Council and its affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, rankings, or achievements, arising from your use of or inability to use the App, even if advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless Texas Airport Council, its affiliates, and their respective officers and employees from any claims, damages, or expenses arising from your use of the App, your violation of these Terms, or your violation of any applicable law or third-party right.

12. Suspension and Termination

We and/or Texas Airport Council administrators reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or applicable law, or that is otherwise harmful to other users, the App, or third parties.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App will be resolved in the state or federal courts located in Texas.
